1. Introduction
Welcome to MarshRidge Photography. These Terms and Conditions govern your use of our website, marshridge.sbs, and the photography services provided by MarshRidge Photography ("we," "our," or "us"). By accessing our website, booking our services, or using any of our photography products, you agree to be bound by these Terms and Conditions.
Please read these terms carefully before using our services. If you do not agree to these terms, please do not use our website or services.
2. Definitions
In these Terms and Conditions:
- "Client" refers to any individual or entity that books or purchases photography services from us.
- "Services" refers to photography services, including but not limited to portrait sessions, wedding photography, event coverage, commercial photography, and any related products or deliverables.
- "Website" refers to marshridge.sbs and all its content.
- "Images" refers to all photographs taken by us during the course of providing Services.
- "Contract" refers to the agreement between MarshRidge Photography and the Client, including these Terms and Conditions and any additional terms specified in a separate booking agreement.
3. Booking and Payment
3.1 Booking Process
All bookings must be confirmed in writing (including email) and are subject to these Terms and Conditions. A booking is not considered confirmed until we have received a signed booking agreement and the required deposit.
3.2 Deposit and Payment Schedule
A non-refundable deposit of 30% of the total fee is required to secure a booking date. The deposit will be deducted from the total fee. The remaining balance is due as follows:
- For weddings and events: The remaining balance is due 14 days before the event date.
- For portrait sessions and commercial photography: The remaining balance is due on the day of the session or before the images are delivered, whichever comes first.
3.3 Payment Methods
We accept payment via bank transfer, credit/debit card, and PayPal. Cash payments are only accepted by prior arrangement.
3.4 Late Payment
Late payments may incur a fee of 5% of the outstanding amount per week. We reserve the right to withhold delivery of images until all payments have been received in full.
4. Cancellation and Rescheduling
4.1 Cancellation by the Client
In the event of cancellation by the Client, the following terms apply:
- Cancellation more than 90 days before the event/session date: The deposit is non-refundable, but any additional payments made will be refunded.
- Cancellation 30-90 days before the event/session date: 50% of the total fee is due.
- Cancellation less than 30 days before the event/session date: 100% of the total fee is due.
4.2 Cancellation by MarshRidge Photography
In the unlikely event that we need to cancel our services due to illness, injury, or other circumstances beyond our control, we will:
- Make every reasonable effort to find a suitable replacement photographer of similar style and professional standard.
- If no replacement can be found, we will refund all payments made, including the deposit.
- Our liability is limited to the refund of any payments made.
4.3 Rescheduling
Requests to reschedule must be made in writing. We will accommodate rescheduling where possible, subject to our availability. Rescheduling fees may apply as follows:
- Rescheduling more than 30 days before the original date: No fee.
- Rescheduling 14-30 days before the original date: 10% of the total fee.
- Rescheduling less than 14 days before the original date: 25% of the total fee.
5. Photography Services
5.1 Photography Coverage
We will provide photography services as outlined in the booking agreement. While we make every effort to capture all the important moments, we cannot guarantee specific shots or capture every guest or moment at an event.
5.2 Creative License
We reserve the right to use our professional judgment and artistic interpretation in capturing and editing images. The Client acknowledges that they are familiar with our portfolio and is hiring us for our style and professional expertise.
5.3 Cooperation
The Client agrees to cooperate and encourage others to cooperate with the photographer in terms of punctuality, following directions, and adhering to the agreed timeline. Failure to cooperate may result in compromised images and is not the responsibility of the photographer.
5.4 Delivery of Images
We strive to deliver images within the following timeframes:
- Portrait sessions: 2-3 weeks
- Events and weddings: 4-6 weeks
- Commercial projects: As specified in the contract
These timeframes are estimates and may vary during busy periods or due to unforeseen circumstances.
6. Copyright and Usage Rights
6.1 Copyright Ownership
In accordance with UK Copyright Law, the photographer retains copyright ownership of all images. The Client is purchasing the right to use the images, not the copyright.
6.2 License for Personal Use
For personal photography services (portraits, weddings, etc.), we grant the Client a non-exclusive, non-transferable license to use the delivered images for personal, non-commercial purposes, including:
- Printing for personal display
- Sharing on personal social media accounts (with credit to MarshRidge Photography)
- Including in personal albums or compilations
6.3 License for Commercial Use
For commercial photography services, usage rights will be specified in the booking agreement. Unless otherwise stated, commercial licenses are limited to the specific usage, media, duration, and territory agreed upon.
6.4 Photographer's Portfolio Rights
The Client grants us the right to use images for our portfolio, marketing materials, social media, contests, and professional recognition. If you have privacy concerns, please discuss these before signing the contract.
6.5 Image Alteration
The Client agrees not to alter the images in any way, including but not limited to filters, cropping, or other editing, without express written permission from MarshRidge Photography.
7. Website Terms of Use
7.1 Website Content
All content on our website, including images, text, graphics, logos, and button icons, is the property of MarshRidge Photography or its content suppliers and is protected by UK and international copyright laws.
7.2 Acceptable Use
You agree to use our website only for lawful purposes and in a way that does not infringe upon the rights of others or restrict or inhibit anyone else's use and enjoyment of the website.
7.3 Prohibited Activities
You must not:
- Use our website in any way that causes, or may cause, damage to the website or impairment of its availability or accessibility
- Use our website for any fraudulent or unlawful purpose
- Reproduce, duplicate, copy or resell any part of our website
- Access without authority, interfere with, damage, or disrupt our website, equipment, systems, or networks
7.4 User-Generated Content
If you post any content on our website (such as comments), you grant us a non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate, and distribute it in any medium. We reserve the right to remove any content that we consider inappropriate.
8. Limitation of Liability
8.1 Force Majeure
We will not be liable for any failure or delay in performing our obligations where such failure or delay results from any cause that is beyond our reasonable control (including but not limited to severe weather, illness, injury, or equipment failure).
8.2 Limitation of Damages
Our liability for any claim, whether in contract, tort, or otherwise, is limited to the amount paid by the Client for the Services. We shall not be liable for any indirect, consequential, or incidental damages.
8.3 Technical Failure
While we take utmost care with our equipment and have backup systems in place, we cannot be held liable for technological failures beyond our control. In the event of complete photographic failure or non-delivery of images due to technical issues, our liability is limited to a full refund of all payments made.
9. Complaints and Dispute Resolution
If you are dissatisfied with our services, please contact us in writing within 14 days of receiving your images. We will make every reasonable effort to resolve any issues. If we cannot reach a mutually satisfactory resolution, disputes will be resolved through mediation or arbitration as specified by UK law.
10. Changes to Terms and Conditions
We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on our website and will be effective immediately upon posting. For existing clients, the Terms and Conditions in effect at the time of signing the booking agreement will apply.
11. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Kingdom. Any disputes relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
